Trade Order Policy

TRADE PRICES

All trade prices quoted exclude VAT, sales taxes and delivery charges. The price list may be altered at any time to take in to account reasonable market conditions and costs.

SAMPLES

Cuttings are provided for information and guidance only. We cannot guarantee an exact match in either colour or quality between a sample and delivered goods.

MINIMUM ORDERS

Feathr’s fabrics and wallpapers are subject to minimum order quantities, please check with your Account Manager. Feathr reserves the right to amend the minimum quantities without notice.

CONFIRMATION OF ORDER

All invoices shall be an offer by Feathr to sell the goods subject to these terms and conditions. The pro forma invoice, together with these terms and conditions, shall form the “Agreement” between us.

Payment of Feathr’s invoice will be treated as confirmation of your order and acceptance of our offer, as per the details on the invoice. Any subsequent change will be confirmed in writing. You are expected to verify that the invoice reflects the correct volume, pattern, colour way, material and base cloth of the design you wish to order.

CANCELLATION

Feathr shall have the right to cancel your order (or any part of it) which has not yet been delivered and shall provide you with a full refund if it exercises this cancellation right.

PAYMENT AND INVOICE VALIDITY

All orders are payable in full before production or dispatch. Unpaid invoices will be void after 2 weeks.

PRODUCTION OF YOUR ORDER

Production of your order will start a) when payment is received or b) when all the details of the order (e.g. delivery details) are received, whichever is later. A delay in receipt of payment or confirmation of specifications will usually lead to a delay in the production of the order.

ORDER AMENDMENTS AND CANCELLATIONS

If you need to increase your order, additional meterage will be produced from the same roll of fabric where possible. Please note that wallpapers produced in different batches may have slight colour disparencies. Your order cannot be amended if Feathr has already put the order in to production. Trade orders cannot be cancelled or returned.

RISK & TITLE

Risk in the goods that you have ordered shall pass to you when they are dispatched or collected.

Title to the goods that you have ordered shall pass to you once the goods are dispatched or collected and Feathr has received payment from you in full and cleared funds for the goods.

DELIVERY

Orders are dispatched from Feathr’s warehouses using leading couriers such as DHL, TNT, UPS, FedEx. Feathr accepts no claims for late deliveries.

ORDER ACCEPTANCE

You or the person receiving your goods on your behalf should unpack and inspect your order immediately on delivery. Please give Feathr notice in writing within 3 days of delivery if any of the goods are not in accordance with the written order, or are damaged or defective, otherwise no claim can be made. No claims can be made for fabrics or wallpapers that have been ordered in error. No claims can be made after the fabric or wallpaper has been cut or hung. Feathr cannot accept claims for non-delivery of the order unless notified in writing within 5 days of the estimated delivery date.

If the product is faulty Feathr will issue a refund or send a replacement product. Feathr’s liability is limited to the cost of the replacement product. No claim for any other costs are accepted, including but not limited to hanging costs, project management costs or delivery costs.

We will make every effort to complete the order on time. If our supply of the products is delayed we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. We will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to end the contract and receive a refund for any products you have paid for but not received. Feathr’s liability is limited to the cost of the product. We will not accept responsibility for any project costs caused by delays.

HAND DRAWN AND PAINTED DESIGNS

Feathr’s fabrics and wallpapers are often inspired by original documents or are drawn or painted by hand. The artwork will therefore include intrinsic irregularities of a hand drawn design which Feathr celebrates. Any design if scaled over a large enough area will produce a dominant repeat of one or more elements. Feathr do not consider this a flaw and as such will not accept claims against this feature.

SUGGESTED USAGE

Please note that the suggested uses for Feathr’s fabric are only recommendations. The durability of any fabric or wallpaper will be affected by the application and treatment of the product, the intensity of its use, its location and the standard of maintenance employed.

Feathr cannot accept claims caused by any reason or conditions of use. It is your responsibility to ensure the wallpapers and fabrics fulfill all fire regulations and requirements set by law and local authorities.

CLEANING INSTRUCTIONS, SHRINKAGE AND FADING

Feathr strongly recommend that when ordering wallpaper, at least one additional roll is included in the order to allow for under estimates and future damage. Please also refer to the hanging instructions which are included in every order. Feathr cannot accept claims for shortages or damage caused by any reason of installation. If Feathr is making the product to measurements you have given us you are responsible for ensuring that these measurements are correct. 

COMPLIANCE

Feathr’s designs comply with all statutory and EU requirements. All other warranties, condition or requirement otherwise implied by interior industry status are excluded.

TERMINATION

Feathr may terminate the Agreement or any other agreement which it has with you at any time by giving you notice in writing if: you commit a material breach of these terms and conditions or you miss payment deadlines or you suffer an insolvency or bankruptcy related event.

These Terms constitute an agreement that shall be governed by and construed in accordance with laws of Finland without regard to its conflict of law provisions and without regard to the actual country of incorporation or residence of either party. You agree to submit to the personal and exclusive jurisdiction of the courts located in Finland, in connection with any action arising under this Agreement, except to the extent otherwise stipulated by applicable mandatory legislation. You agree that any cause of action arising out of or related to this Agreement must commence within one (1) year after the cause of action accrues. Otherwise, such cause of action is permanently barred.
